These Terms of Service ("Terms") govern your use of the Pet Haven Agency website, applications, and online services (collectively, the "Site" or "Services"). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Who We Are

"Pet Haven Agency," "we," "us," or "our" refers to Pet Haven Agency.

Pet Haven Agency is an insurance agency/agency service provider. Insurance coverage is offered and issued by third-party insurance carriers ("Carriers"). The Services may help you obtain quotes, apply for coverage, manage your account, view policy information, and submit claims information.

2) Eligibility

You must be at least 18 years old (or the age of majority in your state) and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements.

3) What the Services Do (and Don't Do)

3.1 Quotes Are Estimates, Not a Promise of Coverage

Any quote you receive is an estimate based on the information you provide and may change based on underwriting, verification, your pet's eligibility, your location, and Carrier rules. A quote is not an offer of insurance and does not guarantee coverage, price, or approval.

3.2 Policies Control

If you purchase coverage, the policy documents issued by the Carrier (including terms, conditions, exclusions, waiting periods, limits, and deductibles) control. If there is any conflict between these Terms and the policy, the policy controls.

3.3 Not Veterinary Advice

We are not a veterinary provider. Nothing on the Site is medical or veterinary advice. For pet health concerns, consult a licensed veterinarian.

4) Your Account

To access certain features (like viewing policies or submitting claims), you may need to create an account.

You agree to:

• Provide accurate, current information.
• Keep your login credentials confidential.
• Notify us immediately if you suspect unauthorized access.

You are responsible for all activity that occurs under your account.

5) Your Responsibilities and Your Information

You agree that information you submit—about you, your pet, and any claim—is true, complete, and accurate to the best of your knowledge.

Providing false, misleading, or incomplete information may result in:

• Quote changes
• Denial of coverage
• Claim denial
• Account suspension or termination

...and may have additional consequences under applicable law and Carrier policy terms.

6) Claims Submissions Through the Portal

The portal may allow you to submit claim information and supporting documents.

You understand and agree:

• Submitting a claim through the portal does not mean it is approved.
• Claims are reviewed under your policy terms by the Carrier and/or its claims administrator.
• We may forward claim information to the Carrier, claims administrators, or service providers as needed to process the claim.
• You are responsible for providing requested documentation and responding to follow-up questions.

7) Electronic Communications and E-Sign Consent

By using the Services, you consent to receive communications electronically (email, SMS/text if enabled, in-app messages, and website notices), including transactional messages about quotes, account activity, policy servicing, and claims.

If the law requires us to provide information "in writing," you agree that electronic delivery satisfies that requirement, to the extent permitted by law. You can withdraw consent by contacting us, but doing so may limit your ability to use certain Services.

8) Acceptable Use

You agree not to:

• Use the Services unlawfully or for fraudulent purposes.
• Attempt to access accounts or data that are not yours.
• Interfere with or disrupt the Services (e.g., hacking, scraping, malware, denial-of-service).
• Upload content that is unlawful, infringing, harmful, or contains viruses.

We may suspend or terminate access if we believe you violated these Terms.

9) Intellectual Property

The Services, including content, branding, text, graphics, logos, and software, are owned by or licensed to Pet Haven Agency and protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial use as intended. You may not copy, modify, distribute, sell, or reverse engineer any part of the Services without our written permission.

10) Third-Party Services and Links

The Services may integrate with or link to third-party sites and services (including Carriers, payment providers, analytics, and claims administrators). We do not control those third parties and are not responsible for their content, policies, or practices. Your use of third-party services may be subject to their terms and privacy policies.

11) Privacy

Your use of the Services is also governed by our Privacy Policy.

12) Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The Services will be uninterrupted, secure, or error-free
• Quotes will be available for every pet or situation
• Claims will be approved (claims decisions are made under policy terms)

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PET HAVEN AGENCY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) $100.

Some states do not allow certain limitations, so parts of this section may not apply to you.

14) Indemnification

You agree to indemnify and hold harmless Pet Haven Agency and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your submission of false, misleading, or unlawful information
• Your infringement of any third-party rights

15) Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time if we believe you violated these Terms, used the Services fraudulently, or if required by law.

Termination of portal access does not, by itself, cancel any insurance policy—policy cancellation is governed by the Carrier's policy and applicable law.

16) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site and update the "Last Updated" date. Your continued use of the Services after changes become effective means you accept the updated Terms.

17) Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

Unless prohibited by law, you agree that any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Texas, and you consent to personal jurisdiction there.

18) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
